Terms of Service — Everymile: Mileage Tracker

These Terms of Service (“Terms”) govern your use of the Everymile app, account, website, cloud services, and related features (collectively, the “Service”).

Everymile (“Everymile,” “we,” “us,” or “our”) is owned and operated by Steve Brassard, an individual in the United States.

By creating an account, purchasing a subscription, or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old, or the age of legal majority where you live, to create an Everymile account or use paid features.

You may use Everymile only in compliance with applicable law.

2. Apple App License

These Terms govern your Everymile account, cloud services, subscriptions, and other services we provide.

Your license to the Everymile iOS application is also subject to Apple’s Standard Licensed Application End User License Agreement and applicable App Store terms. If these Terms conflict with mandatory terms imposed by Apple or applicable law, those terms control to the extent of the conflict.

3. Your Account

If you create an account, you are responsible for maintaining the security of your sign-in credentials and for activity reasonably attributable to your account.

You agree to provide accurate information where requested and to notify us if you believe your account has been compromised.

You may delete your Everymile account at any time through the in-app account-deletion feature where available or by contacting us at support@geteverymile.com.

4. Mileage Tracking and Location

Everymile is designed to help detect, record, organize, and classify drives for mileage, reimbursement, and recordkeeping purposes.

Automatic drive detection depends on factors outside our control, including GPS availability, iOS background execution, device settings, battery state, permissions, cellular or network conditions, operating-system behavior, and other technical conditions.

Everymile may miss a drive, split a drive incorrectly, merge drives incorrectly, record an inaccurate route, or otherwise produce incomplete or inaccurate mileage information.

You are responsible for reviewing your mileage records and correcting them when necessary.

5. Safe Use

Do not interact with Everymile in a way that distracts you while driving.

Set up the app before driving and wait until you are safely parked before reviewing, editing, classifying, or otherwise interacting with trip information unless a feature is specifically designed and legally permitted for safe in-vehicle use.

You are responsible for complying with traffic, distracted-driving, device-use, and other applicable laws.

6. Your Content

Your drive records, classifications, notes, and other information you enter into Everymile remain yours.

You grant us a limited, non-exclusive right to host, process, transmit, back up, and display that information only as reasonably necessary to operate, secure, support, and provide the Service.

You represent that you have the right to provide information you submit to the Service.

7. Acceptable Use

You may not:

• Use Everymile for unlawful, fraudulent, abusive, or harmful purposes.
• Attempt to interfere with, disable, overload, or compromise the Service.
• Attempt to gain unauthorized access to another user’s account or data.
• Reverse engineer, copy, resell, sublicense, or exploit the Service except where applicable law expressly permits it.
• Use automated means to access the Service in a manner that materially interferes with normal operation.
• Use Everymile in a way that endangers you or another person.

8. Free and Paid Features

Everymile may offer free features and paid subscription plans.

The current price, billing period, trial terms, included features, and any promotional offers will be displayed in the app and through the App Store before you purchase.

Prices may vary by country, currency, taxes, App Store pricing, promotions, or other factors.

We may add, remove, or change features associated with a plan, subject to applicable law and App Store requirements.

9. Subscriptions, Trials, Renewal, and Cancellation

Paid subscriptions are processed through Apple and your Apple ID.

If a free trial or introductory offer is available, the duration and applicable terms will be shown before purchase. Unless you cancel before the trial or introductory period ends, the subscription may automatically convert to a paid subscription at the price shown when you subscribed.

Subscriptions renew automatically unless canceled through Apple before the applicable renewal date.

You can manage or cancel subscriptions through your Apple ID or App Store subscription settings.

Deleting your Everymile account does not automatically cancel an App Store subscription. If you want to stop future subscription renewals, you must cancel the subscription separately through Apple.

We may change subscription pricing from time to time. Price changes are administered through the App Store and are subject to Apple’s applicable notice, consent, and renewal requirements.

10. Refunds

Purchases and subscriptions made through the Apple App Store are processed by Apple.

Refund requests must be submitted to Apple and are subject to Apple’s refund policies and approval.

Everymile does not directly issue refunds for App Store purchases.

If Apple approves a refund, your subscription status or access to paid features may be updated accordingly.

Canceling a subscription is separate from requesting a refund. Canceling stops future renewals but does not automatically refund a prior charge.

11. Estimated Tax Deductions and Reimbursements

Everymile may calculate estimated deductions, reimbursements, or mileage values using mileage rates selected by you or provided by the app.

These calculations are estimates only.

Everymile does not determine whether a trip is legally deductible, reimbursable, properly classified, or sufficient to satisfy IRS, employer, state, local, or other recordkeeping requirements.

You are solely responsible for reviewing your mileage records and verifying every drive, classification, rate, calculation, and figure before relying on it for a tax return, reimbursement request, accounting record, audit, or other purpose.

Everymile is not a tax preparer, accountant, financial advisor, attorney, or legal advisor. Nothing in the Service constitutes tax, accounting, financial, or legal advice.

You should consult a qualified professional regarding your specific circumstances when appropriate.

12. Service Providers and Third-Party Services

Everymile relies on third-party platforms and service providers, including Apple, Supabase, RevenueCat, hosting providers, and other infrastructure providers.

Third-party services may be subject to their own terms, policies, availability, and technical limitations.

We are not responsible for interruptions, failures, changes, or acts of third-party services beyond our reasonable control.

13. Changes to the Service

We may modify, update, suspend, or discontinue features or portions of the Service from time to time.

If we discontinue the Service entirely, we will, where reasonably practicable and subject to applicable law, provide advance notice and an opportunity to access or export available mileage records before shutdown.

We do not guarantee that any particular feature, integration, subscription plan, or service will remain available indefinitely.

14. Account Suspension and Termination

You may stop using Everymile at any time.

We may suspend or terminate access to the Service if we reasonably believe you have materially violated these Terms, used the Service unlawfully, threatened the security or integrity of the Service, or created a risk of harm to other users or to Everymile.

Where reasonably practicable, we will provide notice before termination unless immediate action is necessary for security, legal, fraud-prevention, or safety reasons.

15. Account Deletion and Data

You may delete your account through the in-app account-deletion feature where available or by contacting us.

Account deletion is handled as described in our Privacy Policy.

Deleting your account does not automatically cancel an active App Store subscription.

16. Intellectual Property

Except for your content, Everymile and the Service—including the app, software, design, branding, text, graphics, and other materials—are owned by us or our licensors and are protected by applicable intellectual-property laws.

These Terms do not transfer ownership of Everymile or its intellectual property to you.

17. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, ACCURACY, RELIABILITY, AND ERROR-FREE OPERATION.

WE DO NOT WARRANT THAT EVERYMILE WILL DETECT OR RECORD EVERY DRIVE, PRODUCE PERFECT GPS DATA, CALCULATE AN ACCURATE DEDUCTION OR REIMBURSEMENT, OR SATISFY ANY TAX, ACCOUNTING, EMPLOYER, AUDIT, OR LEGAL RECORDKEEPING REQUIREMENT.

Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERYMILE AND STEVE BRASSARD WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST BUSINESS, LOST DATA, LOST MILEAGE RECORDS, LOSS OF TAX BENEFITS, OR TAX ASSESSMENTS, PENALTIES, OR INTEREST ARISING FROM OR RELATED TO THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

1. THE AMOUNT YOU PAID FOR EVERYMILE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
2. US $50.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including any rights you may have under mandatory consumer-protection laws.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Everymile and Steve Brassard from third-party claims, damages, liabilities, costs, and reasonable expenses arising from your unlawful misuse of the Service, your material violation of these Terms, or your infringement of another person’s rights.

This section does not apply to the extent prohibited by applicable consumer law.

20. Governing Law

These Terms are governed by the laws of the State of [Your State], without regard to conflict-of-law principles, except to the extent another jurisdiction’s laws must apply under mandatory consumer-protection rules.

Nothing in this section deprives you of rights that cannot be waived under the laws that apply to you.

21. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we will update the effective date and, where appropriate, provide notice through the app, website, or another reasonable method.

Your continued use of the Service after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

22. Severability and No Waiver

If a provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

Our failure to enforce a provision does not waive our right to enforce it later.

23. Entire Agreement

These Terms, the Privacy Policy, Apple’s applicable App Store terms, and any additional terms presented to you for a specific feature or purchase constitute the agreement governing your use of Everymile.
